Mopeds and scooters
In this current economic climate, mopeds and scooters have become quite prevalent on our local roadways. We are often asked at the Law Office of Philips & Raaymakers PLLC as to what the legal requirements are for those smaller vehicles on the public roadways.
You must be 16 years of age or older and hold a regular operator’s or motorcycle-only license on a public street or roadway if driving a moped or scooter. Insurance is not required for mopeds or scooters. However, if you have caused an accident previously while operating one of these vehicles, you may be required to carry coverage thereafter
on that same type of vehicle.
We always advise our clients that they should purchase some form of medical payment coverage to pay for their medical bills if involved in an accident on their moped or scooter.
If the engine on your moped or scooter is 50cc or less, two brake horsepower or less, and cannot go more than 30 miles per hour on level ground, then you are not required to wear a helmet. If, however, any of your passengers are younger than 16 years of age, they are required to wear a helmet.
We highly recommend that you contact your local Department of Motor Vehicle to ensure that you are following the specific requirements for your moped or scooter.
